1. Agreement to These Terms

These Terms of Use (“Terms”) govern your access to and use of the website located at https://everhartgeneral.com/ and any related online store, content, and services (collectively, the “Site”) operated by The Mangione Group, LLC d/b/a Everhart General (“The Mangione Group, LLC,” “Everhart General,” “we,” “us,” or “our”).

By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

Short version (for clarity only):

  • Products are made-to-order, so all sales are generally final.

  • We will fix verified defects, misprints, damage, or lost-in-transit orders, with required photo proof.

  • We use your information to fulfill orders and may send you marketing about other brands owned by The Mangione Group, LLC, with opt-outs available.

2. Eligibility & Your Account

You may use the Site only if you:

  • Are at least 18 years old (or the age of majority where you live); and

  • Have the legal capacity to enter into a binding contract.

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • Restricting access to your device(s); and

  • All activities that occur under your account.

You agree to notify us promptly at [email protected] if you believe your account or login details have been compromised.


3. Products, Descriptions & Availability

  • Made-to-order production
    Many of our products are manufactured or printed on demand through third-party production partners when you place an order. Minor variations in color, placement, and appearance are normal and expected with this type of production.

  • Product descriptions
    We make reasonable efforts to ensure that product descriptions, images, and other content on the Site are accurate and up to date. However, we do not guarantee that descriptions or other content are error-free, complete, or current. Differences in screens and devices may cause colors and appearances to vary from the final product.

  • Changes, errors & availability
    We may change or discontinue products, modify pricing, or correct errors at any time, with or without notice. We reserve the right to limit quantities and to refuse or cancel any order placed for any reason, including suspected fraud, errors in pricing or product information, or supply/production issues.


4. Pricing, Taxes & Payment

  1. Pricing
    All prices are listed in
    Dollar, unless otherwise indicated. Prices and shipping rates are subject to change at any time, but changes will not affect orders we have already accepted.

  2. Taxes and duties
    Applicable taxes, duties, and fees will be calculated and displayed at checkout where required by law.

  3. Payment authorization
    By submitting an order, you:

    • Represent and warrant that you are authorized to use the selected payment method; and

    • Authorize us (through our payment processors) to charge your payment method for the full amount of your order, including product prices, shipping, and applicable taxes and fees.

If your payment is declined, reversed, or flagged as suspicious, we may cancel or suspend your order.


5. Order Acceptance, Fulfillment & Shipping

  1. Order acceptance
    Your order is an offer to purchase products from us. We are not obligated to accept your order and may refuse or cancel any order in our discretion. Acceptance occurs when we send an order confirmation email.

  2. Fulfillment & production times
    After acceptance, your order is transmitted to our production partners for fulfillment. Typical production time for made-to-order items is approximately
    2–5 business days, but this is an estimate only. Production may take longer during peak periods, holidays, or due to factors outside our control.

  3. Shipping & delivery

    • Shipping time begins once your order has been produced and handed to the carrier.

    • Any delivery dates or timeframes are estimates, not guarantees.

    • Risk of loss passes to you when the carrier takes possession of the shipment.

  4. Incorrect or undeliverable addresses
    If a shipment is delayed, returned, or deemed undeliverable due to an incorrect, incomplete, or undeliverable address you provided, or because it was refused or unclaimed:

    • We are not obligated to provide a refund; and

    • We may, at our discretion, offer to reship the order if the items are still in reshippable condition, provided you pay any additional shipping charges.


6. Returns, Refunds & Replacements

Because our products are custom made-to-order, our default position is that sales are final. We handle issues when we or our production partners are at fault, and we need verifiable proof to do that fairly.

6.1 General Rule – All Sales Final

To the maximum extent permitted by applicable law, all sales are final, and we do not accept returns or provide refunds or exchanges for:

  • Incorrect size, fit, color, or style chosen by you;

  • Change of mind or buyer’s remorse; or

  • Minor color, placement, or appearance variations that fall within reasonable tolerances for print-on-demand products.

6.2 Proof Required for Any Refund or Replacement

We can only consider refunds or replacements where a qualifying issue is verified.

As a strict condition of any refund or replacement:

  1. You must contact us at [email protected] within the applicable timeframe below; and

  2. You must provide clear, dated photo evidence, including:

    • A photo of the entire item;

    • Close-up photo(s) showing the specific defect, misprint, or damage; and

    • If damage appears related to shipping, a photo of the outer packaging and shipping label.

If we do not receive adequate photo documentation, or if the photo documentation does not reasonably support the claimed issue, we may deny any refund or replacement.

We may also, in some cases, request that you return the product for inspection. If we require a return as part of an approved claim, we will inform you whether we or you are responsible for return shipping costs, based on the circumstances and applicable law.

6.3 Defective, Misprinted, or Damaged Items

If you believe an item is defective, misprinted, or damaged in transit, you must:

  1. Contact us at [email protected] within 30 days of the date the order is shown as delivered by the carrier; and

  2. Provide the required photo evidence and a brief description of the issue, along with your order number.

After reviewing your submission (and any returned product, if requested), if we determine in our reasonable discretion that the item is defective, misprinted, or damaged, we will, at our option:

  • Provide a no-cost replacement; or

  • Issue a refund to your original payment method for the affected item(s).

We may deny a claim where:

  • The claim is submitted after the 30-day window;

  • The photos or returned item show misuse, alteration, negligence, improper care, or normal wear and tear; or

  • The issue falls within normal print-on-demand tolerances.

6.4 Lost-in-Transit Orders

If tracking indicates that an order is significantly delayed or appears lost in transit, you must:

  1. Contact us at [email protected] within 30 days of the final tracking update or estimated delivery date; and

  2. Provide your order number and any available tracking details, plus any photos if you received a partial or damaged delivery.

After we review the situation with our carriers and production partners, if we reasonably determine that the order was lost in transit, we may, at our discretion:

  • Issue a replacement shipment; or

  • Provide a refund for the affected item(s).

6.5 “Delivered, But Not Received”

If the carrier’s tracking shows that your order has been delivered but you cannot locate it:

  • First check with household members, neighbors, building/package rooms, or your local postal/delivery office.

  • If you still cannot locate the package, contact us with your order number and details of the steps you have taken.

Because the carrier has recorded the package as delivered, we are generally not obligated to provide a refund or replacement in these situations. However, we may offer a solution (for example, a discounted replacement or other accommodation) as a courtesy, at our sole discretion.

6.6 Consumer Rights

Nothing in this Section 6 is intended to limit any non-waivable rights you may have under applicable consumer protection laws in your jurisdiction. Where those laws require a different outcome, we will follow the law.


7. Acceptable Use

You agree that you will not:

  • Use the Site for any unlawful, fraudulent, or malicious purpose;

  • Interfere with or disrupt the operation or security of the Site;

  • Attempt to gain unauthorized access to the Site, other accounts, or related systems;

  • Use automated tools (such as bots or scrapers) to access or collect data from the Site without our express written permission; or

  • Impersonate any person or entity, or misrepresent your affiliation with us or any other person.

We may suspend or terminate your access to the Site if we reasonably believe you have violated these Terms or pose a risk to us, our customers, or our systems.


8. Intellectual Property

The Site and all content on it—including text, graphics, logos, icons, images, product photos (other than user-submitted photos), video, and software—are owned by or licensed to The Mangione Group, LLC and are protected by copyright, trademark, and other intellectual property laws.

You may:

  • View and print reasonable portions of the Site for your personal, non-commercial use only.

You may not:

  • Copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Site for commercial purposes without our prior written consent.

Our names, logos, and branding—including Everhart General and other brands owned by The Mangione Group, LLC—may not be used without our prior written permission.


9. User Content

If you submit, post, or otherwise provide any content (such as reviews, photos, testimonials, or social media tags) in connection with the Site (“User Content”), you:

  1. Represent and warrant that you own or control all necessary rights in the User Content and that it does not infringe any third-party rights or violate any law; and

  2. Grant The Mangione Group, LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise exploit the User Content in any media now known or later developed, for legitimate business purposes, including marketing and promotion across any brands owned by The Mangione Group, LLC.

We may, but are not obligated to, monitor, remove, or edit User Content in our discretion.


10. Third-Party Services & Links

The Site may include links to or integrations with third-party websites or services (such as payment processors, production partners, or social media platforms). We do not control and are not responsible for:

  • The content, policies, or practices of any third-party websites or services; or

  • Any transactions you enter into with third parties.

Your use of third-party sites and services is at your own risk and subject to their own terms and policies.


11. Disclaimers

To the fullest extent permitted by law:

  • The Site, all products, and all related services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory.

  • We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

  • We do not warrant that product images, previews, or colors displayed on your device will exactly match the final printed product.

Nothing in these Terms is intended to limit any warranties or rights that cannot be limited under applicable law.


12. Limitation of Liability

To the maximum extent permitted by law:

  • The Mangione Group, LLC and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages (including lost profits, lost revenue, lost data, or loss of goodwill) arising out of or relating to your use of the Site, products, or services, even if advised of the possibility of such damages.

  • Our total aggregate liability for any and all claims arising out of or relating to the Site, products, or services will not exceed the amount you actually paid to us for the order giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.


13. Indemnification

You agree to indemnify, defend, and hold harmless The Mangione Group, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site;

  • Your breach of these Terms; or

  • Your violation of any law or the rights of any third party.


14. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Site will be governed by the laws of the State of United States, without regard to its conflict-of-laws rules.

Important: Your attorney should decide whether you want:
• A binding arbitration & class-action waiver clause here, or
• All disputes to be resolved in specific state/federal courts.

Example (for court-based resolution):

Any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the United States, and you consent to the personal jurisdiction of those courts.


15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top. Unless a different effective date is stated, changes are effective when posted on the Site. Your continued use of the Site after any changes means you accept the updated Terms.
